UNDERSTANDING YOUR RIGHTS

Slips and Falls at Work Are More Common Than You Think

Slips, trips and falls are among the most common types of workplace accident in the UK, accounting for a significant proportion of all non-fatal injuries reported to the Health and Safety Executive (HSE) each year.

Employers have a legal duty of care under the Health and Safety at Work Act 1974 and the Workplace (Health, Safety and Welfare) Regulations 1992 to maintain safe working environments. When they fail in that duty and you are injured as a result, you are entitled to make a personal injury clai.

At NJS Law, our experienced solicitors handle workplace accident claims on a no win, no fee basis, meaning there is no financial risk to you in pursuing your claim.

COMMON CAUSES

What Causes Slips, Trips and Falls at Work?

Wet or Slippery Floors

Spills, cleaning activities or leaks that aren’t promptly signposted or cleaned up pose a serious hazard.

Uneven or Damaged Surfaces

Broken flooring, damaged tarmac, loose tiles or worn carpet can all lead to trip injuries.

Poor Lighting

Inadequate lighting in stairwells, walkways or car parks makes it harder to spot hazards underfoot.

Obstructions in Walkways

Boxes, cables, equipment or other items left in corridors or thoroughfares are a common tripping hazard.

Inadequate Footwear Provision

Where safety footwear is required and not provided, employers may be liable for resulting injuries.

Lack of Handrails or Barriers

Staircases, ramps and raised platforms without adequate guarding increase the risk of a fall significantly.

Outdoor Hazards

Icy paths, potholes, or poorly maintained outdoor areas within the employer’s control can be grounds for a claim.

Inadequate Risk Assessments

Employers failing to carry out proper risk assessments and act on identified hazards may be in breach of their duty.

Accident at Work Claims: Your Questions Answered

Have questions about making a workplace injury claim? Our specialist solicitors have answered the most common queries below. If yours isn’t covered, call us for a free no-obligation chat.

Can I claim if the accident was partly my fault

Yes. Under the principle of contributory negligence, you can still make a claim even if you were partially responsible for the accident. Your compensation may be reduced to reflect your share of responsibility, but you are not prevented from claiming altogether.

Your employer is legally prohibited from dismissing or penalising you for making a genuine personal injury claim. In practice, claims are handled by your employer’s liability insurers, not directly by your employer.

Employer’s liability insurance is a legal requirement for most UK emloyers. If your employer is uninsured, claims may still be pursued directly against them or, in certain circumstances, through other avenues. Our solicitors will advise you on the appropriate route.

In most cases, the time limit for a personal injury claim in the UK is three years from the date of the accident. There are exceptions for industrial disease claims and cases involving children. It’s always advisable to begin the process as early as possible whilst evidence is fresh.

A Conditional Fee Agreement (no win, no fee) means that if your claim is unsuccessful, you pay nothing to NJS Law. If your claim succeeds, a success fee is charged, capped by law. We’ll explain all costs fully and clearly before you commit to anything.

YOUR LEGAL RIGHTS

Your Employer's Legal Duties Under UK Health & Safety Law

Under the Health and Safety at Work Act 1974, every employer in the United Kingdom has a general duty of care to ensure, so far as is reasonably practicable, the health, safety, and welfare of all employees. More specific duties are set out in regulations including the Manual Handling Operations Regulations 1992, the Provision and Use of Work Equipment Regulations 1998 (PUWER), the Personal Protective Equipment at Work Regulations 1992, the Work at Height Regulations 2005, and the Control of Substances Hazardous to Health Regulations 2002 (COSHH).

When an employer breaches these duties — through inadequate training, lack of safety equipment, poor risk assessments, defective machinery, or simple indifference to employee welfare — and an employee suffers injury as a direct result, that employee has a legal right to pursue a compensation claim. You can learn more about your rights after a workplace accident in our guide on legal rights following a workplace accident in the UK.
