Different Types of Clinical Negligence Claims

This week’s Legal Minute Monday is a general refresher on the clinical negligence work we do at NJS Law. Richard Shilcock runs through the main types of claim we handle, some common examples, and the time limit that applies.

Here’s the full picture behind this week’s 60-second explainer, including the two main categories of claim, some examples of what they cover, and how long you have to bring one.

The Short Answer

The Two Main Types of Clinical Negligence Claim

Clinical negligence covers a broad range of situations, but these tend to fall into two main categories.

  • Medical negligence, relating to care provided by doctors, surgeons, and other medical professionals.
  • Dental negligence, relating to care provided by dentists and dental professionals.

You can read more about medical negligence on our clinical negligence claims service page.

Examples of Clinical Negligence

Within these two categories, we’re able to assist with a range of situations, including:

  • Injuries sustained during surgery
  • Misdiagnosis
  • Delayed treatment

How Long Do You Have to Make a Claim?

As with other personal injury claims, clinical negligence claims are subject to a time limit. You generally have three years from the date the negligence occurred. In many cases, however, the clock instead starts from the date you became aware that the negligence caused you loss, known as the “date of knowledge,” which can be later than the date of the negligence itself.
