We break the probate process down into two stages; firstly, the work required to obtain grant of probate/letters of administration, and then, secondly, the work required after the grant is obtained to distribute the estate.
The amount of work involved will also depend on the size and complexity of the estate and whether inheritance is payable.

If Inheritance tax is not due this is called an excepted estate. For deaths prior to and including 31st December 2021 there is a requirement to submit the IHT205 to HMRC. For deaths on or post 01-01-2022 the value of the estate has to be recorded on the Probate application.
If Inheritance tax is payable on an estate, the tax is not included in our estimate of fees and disbursements.
Inheritance Tax is payable before probate is granted. If the estate includes property, only one-tenth of the tax attributable to the property is payable prior to probate being issued, with the balance payable over the next 10 years (interest is charged at, currently, 3.25% per annum) or on the sale of the property.

Please note that applications with the Probate Registry are taking between 4 – 16 weeks depending on the complexity of the estate. |
Following the grant being issued, the executors/administrators must gather in the assets of the deceased, discharge any liabilities and then distribute the estate in accordance with the Will or the intestacy rules. The work usually involved is:
Our charges for administering the estate are dealt with on an hourly rate basis our rates are all subject to VAT at 20% and range between £126 – £255 depending on the experience of the lawyer dealing with the matter for you.
On average, fees to complete the estate administration are between £1,000 – £2,500 plus VAT (charged at 20%) unless the estate is highly complex. We do not charge a percentage of the estate value.
