Three quick checks

Most claims need all three — worth checking before you fill anything in.

1

It happened — or you found out — in the last three years

Most claims must start within three years of the treatment, or of when you first realised it had harmed you. Different rules apply to children.

2

The care fell below an acceptable standard

A diagnosis was missed or delayed, a procedure went wrong, or you were given the wrong treatment or medication.

3

It caused you avoidable harm

Your condition got worse, you needed further treatment, or your recovery took longer than it should have.

How your claim works

Four stages, from first call to compensation.

  1. 01

    Free eligibility check

A specialist listens to what happened and tells you honestly whether you have a claim.

  2. 02

    Records & expert review

We obtain your medical records and instruct an independent medical expert to review the care you received.

  3. 03

    Claim pursued

We deal with NHS Resolution, the private provider or their insurer for you — including lost earnings, care and future treatment costs.

  4. 04

    No win, no fee

You only pay if you win. Our fee is then an agreed percentage of your compensation, capped and set out in writing before you sign — so nothing comes out of your own pocket.

What you can claim for

Any of these, caused by negligent care, could form the basis of a claim.

  • Misdiagnosis & delayed diagnosis
  • Delayed cancer diagnosis
  • Surgical errors
  • Birth & maternity injuries
  • Medication & prescription errors
  • GP, A&E & dental negligence

Common questions

Will it cost me anything if my claim doesn’t succeed?

No. We act under a genuine no win, no fee agreement, which means you don’t pay our fees if your claim is unsuccessful.

Will making a claim affect my NHS care?

No. Claims against the NHS are handled by NHS Resolution in England, or NHS Wales Legal & Risk Services in Wales — not by the doctors treating you — and making a claim shouldn’t affect your future care.

How long do I have to make a claim?

Usually three years from the date of the negligence, or from when you first realised you’d been harmed by it. For children, the three years starts on their 18th birthday. If someone lacks the mental capacity to manage a claim, the time limit doesn’t run while that continues.

Do I have to make a complaint first?

No. A complaint can get you answers and an apology, but you don’t need to make one before claiming — and it doesn’t pause the three-year time limit. We can advise you on both.

Can I claim if a loved one died?

Yes. Certain family members may be able to claim for bereavement, funeral costs and the loss of financial support. The time limit is usually three years from the date of death, or from when the family learned it was caused by negligence.

How long does a claim take?

It depends on how complex your case is. Expert evidence takes time, and the hospital or provider has four months to respond to a formal letter of claim. Many claims settle without going to court, and we’ll give you a realistic timescale once we’ve reviewed your records.
